Prize Draw Terms and Conditions

Introduction

This prize draw is organized by TAP, hereinafter referred to as the "Organizer". By entering this prize draw, participants agree to abide by the following Terms and Conditions.
Eligibility
- Entrants must be at least 18 years old as of the date of entry.
- Employees, immediate family members of employees, and employees of any company associated with the promotion are ineligible to enter.
- Entrants must be residents of New South Wales.
Duration

The prize draw will commence on 25/08/2023 and conclude on 29/09/2023. Entries submitted after this date will not be accepted.
How to Enter

Prizes

- If the winners are unable to be contacted within [specific time period, e.g., 7 days] of the prize draw date, the Organizer reserves the right to draw a replacement winner.
Prize Draw

The draw will be held on 29/09/2023, and winners will be chosen at random from all eligible entries. The decision of the Organizer is final and no correspondence will be entered into regarding the outcome.
Notification

Winners will be notified by [method of notification, e.g., email, phone, etc.] within [specific time period, e.g., 48 hours] of the prize draw.
General
- The Organizer reserves the right to verify the validity of entries and to disqualify any entry that is not in accordance with these Terms and Conditions.
- The Organizer's decision is final and binding on all participants in relation to this prize draw, and no correspondence will be entered into.
- If this prize draw is interfered with in any way or cannot be conducted as anticipated due to any reason beyond the control of the Organizer, the Organizer reserves the right to modify, suspend, terminate or cancel the prize draw, as appropriate.
Legal Compliance

This prize draw is conducted in accordance with the laws and regulations of New South Wales. Any disputes arising out of this prize draw will be subject to the jurisdiction of the courts of New South Wales.
Privacy

By entering this prize draw, participants consent to the Organizer's use of their personal information for the purpose of conducting the prize draw. All information will be collected and stored in accordance with the Organizer's Privacy Policy.
Liability

The Organizer is not responsible for any loss, damage or injury suffered by participants as a result of entering this prize draw or accepting and using the prizes, except for any liability which cannot be excluded by law.

Our Service

TAP and services provided to you on and through TAP are on an "as is" basis. You agree that the owners of TAP exclusively reserve the right and may, at any time and without notice and any liability to you, modify or discontinue TAP and its services or delete the data you provide, whether temporarily or permanently. We shall have no responsibility or liability for the timeliness, deletion, failure to store, inaccuracy, or improper delivery of any data or information.

Your Responsibilities and Registration Obligations

In order to use TAP, you must register on our site, agree to provide truthful information when requested, and be at least the age of thirteen (13) or older. When registering, you explicitly agree to our Conditions of Use and as may be modified by us from time to time and available here.

Registration data and other personally identifiable information that we may collect is subject to the terms of our Privacy Notice.

Registration and Password

You are responsible to maintain the confidentiality of your password and shall be responsible for all uses via your registration and/or login, whether authorised or unauthorised by you. You agree to immediately notify us of any unauthorised use of your registration, user account or password.

You agree that all information or data of any kind, whether text, software, code, music or sound, photographs or graphics, video or other materials ("Content"), publicly or privately provided, shall be the sole responsibility of the person providing the Content or the person whose user account is used. You agree that TAP may expose you to Content that some may find to be objectionable or offensive. We shall not be responsible to you in any way for the Content that appears on TAP nor for any error or omission.

You explicitly agree, in using any service provided, that you shall not:

(a) provide any Content or perform any conduct that may be unlawful, illegal, threatening, harmful, abusive, harassing, stalking, defamatory, libellous, vulgar, obscene, offensive, objectionable, pornographic, designed to or does interfere or interrupt TAP or any service provided, infected with a virus or other destructive or deleterious programming routine, give rise to civil or criminal liability, or which may violate an applicable local, national or international law;

(b) impersonate or misrepresent your association with any person or entity, or forge or otherwise seek to conceal or misrepresent the origin of any Content provided by you;

(d) provide or use TAP and any Content or service in any commercial manner or in any manner that would involve junk mail, spam, chain letters, pyramid schemes, or any other form of unauthorised advertising without our prior written consent;

(e) provide any Content that may give rise to our civil or criminal liability or which may constitute or be considered a violation of any local, national or international law, including but not limited to laws relating to copyright, trademark, patent, or trade secrets.

Third Party Services

Goods and services of third parties may be advertised and/or made available on or through TAP. Representations made regarding products and services provided by third parties are governed by the policies and representations made by these third parties. We

shall not be liable for or responsible in any manner for any of your dealings or interaction with third parties.

Indemnification

You agree to indemnify and hold us harmless, our subsidiaries, affiliates, related parties, officers, directors, employees, agents, independent contractors, advertisers, partners, and co-branders from any claim or demand, including reasonable attorney’s fees, that may be made by any third party, that is due to or arising out of your conduct or connection with TAP or service, your provision of Content, your violation of this Conditions of Use or any other violation of the rights of another person or party.

Disclaimer of Warranties

You understand and agree that your use of TAP and any services or content provided (the “Service”) is made available and provided to you at your own risk. It is provided to you “as is” and we expressly disclaim all warranties of any kind, implied or express, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranty, implied or express, that any part of the service will be uninterrupted, error-free, virus-free, timely, secure, accurate, reliable, of any quality, nor that any content is safe in any manner for download. You understand and agree that neither us nor any participant in the service provides professional advice of any kind and that use of such advice or any other information is solely at your own risk and without our liability of any kind.

Limitation of Liability

You expressly understand and agree that we shall not be liable for any direct, indirect, special, incidental, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible loss (even if we have been advised of the possibility of such damages), resulting from or arising out of (i) the use of or the inability to use the service, (ii) the cost to obtain substitute goods and/or services resulting from any transaction entered into on through the service, (iii) unauthorised access to or alteration of your data transmissions, (iv) statements or conduct of any third party on the service, or (v) any other matter relating to the service.

Reservation of Rights

We reserve all of our rights, including but not limited to any and all copyrights, designs, trademarks, patents, trade secrets, and any other proprietary right that we may have in TAP, its content, and the goods and services that may be provided. The use of our rights and property requires our prior written consent. We are not providing you with any implied or express licences or rights by making services available to you and you will have no rights to make any commercial uses of TAP or service without our prior written consent.

Notification of Copyright Infringement

If you believe that your property has been used in any way that would be considered copyright infringement or a violation of your intellectual property rights, please contact us.

Applicable Law

You agree that this Conditions of Use and any dispute arising out of your use of TAP or our products or services shall be governed by and construed in accordance with local laws where the headquarters of the owner of TAP is located, without regard to its conflict of law provisions. By registering or using TAP and service you consent and submit to the exclusive jurisdiction and venue of the county or city where the headquarters of the owner of TAP is located.

Miscellaneous Information

(i) In the event that this Conditions of Use conflicts with any law under which any provision may be held invalid by a court with jurisdiction over the parties, such provision will be interpreted to reflect the original intentions of the parties in accordance with applicable law, and the remainder of this Conditions of Use will remain valid and intact

(ii) The failure of either party to assert any right under these Conditions of Use shall not be considered a waiver of any that party's right and that right will remain in full force and effect;

(iii) You agree that without regard to any statue or contrary law that any claim or cause arising out of TAP or its services must be filed within one (1) year after such claim or cause arose or the claim shall be forever barred;

(iv) We may assign our rights and obligations under these Conditions of Use and we shall be relieved of any further obligation.

Severability Clause

If a provision of these Conditions of Use is or becomes illegal, invalid or unenforceable in any jurisdiction, that shall not affect the validity or enforceability in that jurisdiction of any other provision of this Conditions of Use; or the validity or enforceability in other jurisdictions of that or any other provision of this Conditions of Use.

ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order placed with us. We may limit or cancel quantities purchased per person, per household or per order at our discretion. These restrictions may apply to orders from the same customer account or using the same billing and/or shipping address. We will strive to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made if we make changes to or cancel an order. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You also agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

ERRORS AND OMISSIONS

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice.

You are prohibited from using the site or its content for any unlawful purpose, including the infringement upon or violation of our intellectual property rights or the intellectual property rights of others, submitting false or misleading information, and uploading or transmitting viruses or any other type of malicious code.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless our company and our affiliates, partners, officers, directors, agents, contractors, service providers, subcontractors, suppliers, interns and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Referral program

Eligibility: Both the referrer and the referee must be over 18 years of age and residents of Australia. The referrer must have made at least one purchase from our store.
Minimum Purchase: To qualify for the referral incentives, the referee's first purchase must total at least $2300 AUD in a single transaction. Purchases made across multiple transactions will not cumulatively count towards this total.
Time Frame for Redemption: The referrer's earned discount or cashback reward must be redeemed within four months from the date of issue. Beyond this timeframe, the reward will be considered expired and will no longer be redeemable.
Dispute Resolution: Any disputes arising from or in connection to the Referral Program should first be reported to Titanium Auto Parts. We are committed to resolving such issues amicably. However, if the dispute cannot be resolved, it will be subject to mediation or arbitration in accordance with the laws of New South Wales, Australia.
Expiry of Program: Titanium Auto Parts reserves the right to terminate the Referral Program due to reasons including but not limited to lack of funds, changes in law, or a decision by management. Participants will be notified in advance of any such termination, where possible.

Referral Method: The referrer must share their unique car code (found on their receipt or quote, e.g., B-M340-Ti) with their friends. The referee must enter this car code in the 'referral code' section during checkout when making their first purchase.
Incentives: The incentives of this program apply only when the referee makes a purchase amounting to $2300 AUD or more. For Option 1, when the referee makes their first purchase, the referrer gets a $150 discount on their next order, and the referee gets a $300 discount on their purchase. For Option 2, the referrer gets $100 cashback, and the referee gets a $150 discount on their first purchase.
Limitations: The referral discount cannot be combined with other offers or promotions. Each customer can refer up to 10 friends.
Fraudulent Activity: Participants in the referral program must not create multiple accounts. Any attempt to create multiple accounts or to deceive Titanium Auto Parts in order to gain an unfair advantage or benefit from the program in a way that is against these terms and conditions will be considered a breach of these terms and could result in legal action. Titanium Auto Parts reserves the right to ban or disqualify any participants who are found to be breaching these terms. Any incentives earned fraudulently will be invalidated, and the participant could be required to return any benefits received from the referral program.
Privacy: By participating in this program, you consent to us using your personal information for the purposes of administering this program. Please refer to our privacy policy for more information.
Changes to the Program: We reserve the right to change or terminate this program at any time, without prior notice.
Governing Law: These Terms and Conditions are governed by the laws of New South Wales, Australia.

Return Shipping Policy

Policy on Returns and Exchanges of Non-Defective Merchandise

Your satisfaction is our priority at TAP, and we are committed to providing high-quality, specific-grade products. It's important to note that we do not accept returns or offer refunds for non-defective items due to a change of mind, including personal preferences related to the design or sound of the product.

However, TAP acknowledges that there may be instances where you wish to exchange a non-defective item. In such cases, we allow exchanges within 14 days of purchase, provided the item is in its original packaging and in a pristine, resalable condition. Please be aware that items that have been opened/used/installed or are missing included hardware are not eligible for exchange.

We advise that all associated shipping and handling fees for the exchange process will be the responsibility of the customer. This policy is in alignment with our commitment to ensuring a high-quality customer experience and product satisfaction.

Defective Merchandise and Refunds

Titanium Auto Parts (TAP) is committed to providing high-quality products. In the unfortunate event that you receive a defective product, we kindly ask you to report this within seven(7)days of receiving the item. For the purpose of protection, all dispatched packages will carry insurance coverage up to $100 (AUD) to compensate for potential damages incurred during transit. The provision of substantial evidence is mandatory to ascertain the appropriateness of issuing a refund. If the product is assessed to be defective, not due to any action of the customer, TAP's policy is to offer a refund equal to the original purchase price or an exchange as per the customer's preference in compliance with the Australian Consumer Law.

Sale and Pre-Order Merchandise

Cancellation of a pre-order will attract a 20% fee if the item was paid in full at the time of pre-order. Kindly note that pre-order products are custom-made in limited quantities.

Shipping Information

Customers are responsible for ensuring correct shipping information.Orders can not be cancelled once they have been dispatched. Additionally, orders cannot be redirected to a new address once they have been fulfilled and dispatched.

**Shipping Times**

Please note that in the current climate and due to various circumstances, including public holidays and other unforeseen situations, all orders may be subject to significant delays. We regret that we cannot provide refunds if the package is still in transit. We encourage customers to reach out to us directly if they continue to experience prolonged delays in their shipment. Your patience and understanding in these matters are greatly appreciated.

**Amendments to Policy**

TAP reserves the right to modify these Terms and Conditions periodically. It is the duty of the customer to frequently review this policy to remain informed about any changes. Amendments to our Terms and Conditions become effective immediately upon being posted on our website, in compliance with the laws of New South Wales, Australia.

Deliveryyy

At checkout, you will be provided with three freight options: flat rate and with insurance. Freight insurance covers cases of lost or damaged goods in transit. It is recommended for fragile or high-value items as orders lost or damaged in transit without insurance will not be replaced.

The freight companies we partner with generally make deliveries from Monday to Friday. We suggest providing a postal address where someone is available for collection during business hours. Please ensure shipping details are correct as not all shipments can be redirected once in transit.

If required, we do allow 'authority to leave', granting the freight company permission to leave the order in what they deem a safe location. If 'authority to leave' is denied, the courier will leave a card in your post box indicating where you can collect the package. Failure to collect may result in goods being returned to TAP and additional charges may be required for reshipping orders.

By selecting 'yes' for 'Authority to leave', you agree that the parcel is deemed received when left at your premises. TAP and associated delivery contractors are not responsible for any loss or damage resulting from this delivery method. If 'Authority to leave' is not given, someone must be at your premises for the delivery to occur.

**Order Processing**

For products that are readily available and in stock, orders will be processed and prepared for shipping within 1-3 business days from the date of order confirmation. The stock status of each product is clearly displayed on our website.

If the estimated date of delivery for an item extends beyond the initial estimate provided on the product page, our customer service team will promptly notify customers. For orders that include a backordered product, the complete order will be dispatched only once all the products are available in stock. Customers who wish to arrange a split delivery or inquire about the estimated arrival time of backordered products are encouraged to contact us.

For stainless steel exhaust systems, please note that there is a production time of approximately 1 week before the product can be shipped out. For titanium exhaust systems, the manufacturing time is approximately 1-2 weeks, as each product is handcrafted to ensure 100% quality.

Shipping Destinations

For international shipping, we use DHL Express and other shipping companies. Please note that if your delivery address is outside of Australia, you may have to pay import duties and taxes, which are levied once the shipment reaches your country. All international shipments may be subject to cross-border inspections by customs authorities. Customs policies vary widely from country to country. You must meet any additional charges for customs clearance. We recommend that you contact your local customs office for further information.

Sea Shipping

For larger items such as exhausts with dimensions of 1505 X 450 X 270mm. The estimated shipping cost is around 250 AUD and may be included in orders over 2500 AUD. The estimated delivery time is approximately 30-45 business days.

Air Shipping Express

For expedited shipping, The estimated shipping cost for an item with dimensions 1505 X 450 X 270mm is(approximately 750 AUD) and may be included in orders over 6500 AUD. The estimated delivery time is 5-9 business days.

All terms and conditions are in accordance with the laws of New South Wales, Australia. Please be aware that shipping costs depend on either the volume or weight of the package, whichever is greater. TAP sources quality products both locally and internationally.

Payment & Pricing

Payment Options

To facilitate a smooth and convenient shopping experience, Titanium Auto Parts (TAP) offers a wide range of payment options. We accept credit cards (including MasterCard, Visa, and American Express), Afterpay, Zip Pay, Apple Pay, Google Pay,WeChat Pay, Alipay and PayPal through our online checkout system.

For customers who prefer Direct Deposit, we are able to process these orders manually once the payment is confirmed in our account. For those who wish to pay in person, we accept Cash/EFTPOS on pickup at our physical store located in Sydney.

As per the laws and regulations of New South Wales, all payments must be made in Australian dollars.

**GST and Pricing**

In line with the Australian Goods and Services Tax (GST) law, all prices displayed on the TAP website are inclusive of GST. This approach provides transparency and ensures fairness in our pricing. We believe that inclusive pricing provides a more straightforward and comprehensible shopping experience for our customers.

Please note that any changes to the GST rate set by the Australian Taxation Office will be immediately reflected in our prices. In the event of such changes, we will update our product prices accordingly to include the revised GST amount.

Terms and Conditions

For car detailing

Service Area and Fees:
- Services within 15 kilometers of Macquarie Park include free "To Your Door" delivery.
- Locations beyond 15 kilometers incur an $80 fee for "To Your Door" service.
- Dropping off your car at our facility incurs no service fee.
Booking and Deposit:
- A 20% deposit is required at the time of booking.
- The deposit is non-refundable if cancellation occurs less than 24 hours before the scheduled service.
Pricing and Condition Assessment:
- Final service pricing may vary based on the vehicle's condition upon presentation.
- We document the vehicle's condition with before-and-after photos during the assessment.
Liability:
- Our liability for the vehicle concludes once the service is complete and the vehicle is returned to the customer.
- We are not liable for any damages or issues occurring after the service completion and vehicle return.
Service Guarantee:
- Satisfaction with our services is guaranteed. Concerns about service quality should be reported within 24 hours for resolution.
Cancellation Policy:
- Cancellations must be made at least 24 hours before the scheduled service to avoid a cancellation fee.
Compliance with NSW Law:
- Our services comply with New South Wales (NSW) law, and any disputes will be resolved according to local laws and regulations.
Amendments to Terms and Conditions:
- We reserve the right to modify these terms and conditions without prior notice. Continued service use after changes indicates acceptance of new terms.
